Civil Process Information

The Civil Process Division is located on the Second Floor of the Law Enforcement Center at 320 W 4th St. in Sioux Falls SD.   The phone number is (605) 367-4331.

The Civil Division is comprised of a Sergeant, three deputy sheriffs, one certified civil process server, two office assistants, and seven part time civil process servers.

The Minnehaha County Sheriff’s Office Civil Division has the responsibility of serving and executing court-issued documents. Among the most common documents served by the Sheriff’s Office include Writs of Possession, Writs of Execution, Distress Warrants, Summons and Complaints, Protection Orders and subpoenas for criminal and civil cases. We also serve other legal documents as received from the Courts, attorneys and private citizens.

 

3 Steps to Submitting Civil Papers to be served by the Sheriff’s Office:

 

1. Form

a. Fill out Civil Process Cover Letter located under Civil Forms.

 

2. Document Submission

a. Mail or bring to the following address (if the documents needing to be served are over 15 pages or if you are sending pre-payment in the form of a cashier’s check or money order this is the preferred method):

Civil Process Fees

All Civil Paper Service Fees will need to be pre-paid to the Minnehaha County Sheriff’s Office. The fee to be pre-paid will be determined by the type of paper being served (please see chart below, additional fees may apply). A $15.00 mileage deposit will also need to be pre-paid for those paper types in the chart that specify mileage will be charged. Once the outcome of the paper service has been finalized, mileage will be assessed at the actual mileage rate (current rate of $0.75 per mile). If actual mileage assessed is less than $15.00, a refund will be issued. If actual mileage assessed is more than $15.00, an invoice will be sent for the remaining balance of mileage owed (see below example):

 

Example:

• Garnishment = $50.00
• Mileage Deposit = $15.00
• Total Due when papers are delivered to our office = $65.00

Example Outcomes:

• Paper is successfully served with 10 miles recorded for service = $50.00 for the service of paper plus $7.50 for actual mileage = $7.50 refund for unused mileage.
• Paper is successfully served with 30 miles recorded for service = $50.00 for the service of the  paper plus $22.50 for actual mileage = $7.50 invoice will be sent for additional payment.
• Paper is unsuccessfully served with 10 miles recorded for service = $7.50 for actual mileage = $57.10 refund for unserved paper and unused mileage.
• Paper is unsuccessfully served with 30 miles recorded for service = $22.50 for actual mileage = $42.50 refund for the unserved paper ($50.00 minus $7.50 for the additional mileage costs).
